Administrative Policy

Motion:  that the SOPPs be amended that there be no restriction on the number of consecutive terms that chair or vice chair can serve.

Substitute motion: to require an annual election of the chairman and vice-chairman and limit the chairman and vice-chairman to two consecutive terms

Joint Reef Fish/Shrimp

 

Motion:  to develop two joint reef fish shrimp amendments to address red snapper rebuilding

 

The first amendment would be expedited for completion and contain the following actions:

Shrimp BRD certification

Modifications to bycatch reduction criteria for shrimp

Red snapper TAC adjustments

Red snapper size limits

Red snapper recreational season dates

Red snapper recreational bag limits

Shrimp limits on trawling gear

Shrimp restrictions of transfer of vessel permits

 

Amendment:  to add area closures for shrimping

Amendment carried by voice vote

Motion:  Let Mr. Swingle and Council staff go through the document and arrange it in a more appropriate/organized format for the Council’s review.

Law Enforcement

Motion:  to invite a member of the LEAP to attend the Council meetings with the Council paying the expense of that person.

Motion:  to continue to fund the two LEAP workgroup meetings per year, for the next two years.

Amendment 26 – Red Snapper IFQ

 

Motion: For Section 4.1 – IFQ Program: modify Preferred Alternative 2: “implement an individual fishing quota (IFQ) program in the GOM red snapper fishery.”

 

Motion carried with no objection

 

 

Motion:  Section 4.3: For Alternatives 2 and 3 change “shall possess” to “shall own”

Motion:  Section 4.5 – Action 5 add another suboption under 2a: iv. To allow the current holder of a Class 1 historical captain license to select 7 consecutive years.

Motion:  For Section 4.6: To add at the end of the Preferred Alternative 2: Landings from the 1990 through 1992 period are not subject to appeal.  Landings records appeals for 1993-2004 will be based on NMFS’ logbooks.

 

Amendment: to add at the end: “to the extent practicable”

 

Substitute Amendment:  Landings records appeals for 1993-2004 will be based on NMFS’ logbooks.  If NMFS’ logbooks are not available; state landings records or data that were submitted on or before June 30, 2005 can be used.

Amended Motion:  For Section 4.6: To add at the end of the Preferred Alternative 2: Landings from the 1990 through 1992 period are not subject to appeal.  Landings records appeals for 1993-2004 will be based on NMFS’ logbooks. If NMFS’ logbooks are not available; state landings records or data that were submitted on or before June 30, 2005 can be used.

Motion:  For Section 4.6: add a Preferred Alternative 5: A total of 3 percent of the current commercial quota will be initially set-aside to be used to resolve disputes regarding eligibility until the appeals process is finalized.  Any amount remaining in the set-aside after the appeals process has been terminated will be proportionately distributed back to the initial recipients as soon as possible that year.

Motion:  For 2007 issue 51 percent of 5 mp which is 2.55 mp of the initial quota; any quota share balance resulting from a decision to specify a larger TAC would be distributed   after the date the new TAC becomes effective (i.e., 30 days after the final rule is published), but no later than July 1st.   

 

Substitute Motion:  For Section 4.9 add a Preferred Alternative 5: For 2007 issue 51 percent of 5 mp which is 2.55 mp of the initial quota; any quota share balance resulting from a decision to specify a larger TAC would be distributed after the date the new TAC becomes effective (i.e., 30 days after the final rule is published), but no later than July 1st.

   

2nd Substitute Motion:  For Section 4.9 add a Preferred Alternative 5: For 2007 issue 51 percent of 5 mp, which is 2.55 mp of the initial quota, or 51 percent of whatever TAC has been selected as the Preferred Alternative by the Council and submitted to the Secretary of  Commerce.  Any quota share balance resulting from a decision to specify a larger TAC, would be distributed after the date of publication of the final rule setting the new TAC, but no later than July 1, 2007.

Motion:  For Section 4.10 – Vessel:  That Preferred Alternative be 2A:  Require all fishing vessels engaged in harvesting red snapper in the IFQ program to be equipped with VMS.  The purchase, installation, and maintenance of VMS equipment must conform to the protocol established by the NMFS in the Federal Register.  A)  The Purchase, installation, and maintenance of the VMS equipment communication costs will be paid for or arranged by the owner of the IFQ shares. 

 

Motion carried by a vote of 13 to 2

 

Substitute Motion:  For Section 4.10 – Vessel:  That Preferred Alternative be 2b:  Require all fishing vessels engaged in harvesting red snapper in the IFQ program to be equipped with VMS.  The purchase, installation, and maintenance of VMS equipment must conform to the protocol established by the NMFS in the Federal Register.  B)  The Purchase, installation, and maintenance of the VMS equipment communication costs will be paid for by NMFS.

Motion:  For Section 4.11, That the preferred Alternative be 2a(i) with 2b(i) and 2c(i) – the IFQ license holder will submit the fees

All cost recovery fees shall be the responsibility of the recognized IFQ shareholder.  The fee collection and submission will reside with the recognized IFQ shareholder. 

The fees would be calculated at the time of the sale of fish to the registered IFQ dealer/processor.

A.    The collected fees would be submitted by the IFQ shareholder to NMFS (i) quarterly.

B.    For all IFQ pounds landed and sold, the cost recovery fee will be based on: (i) the 

       actual* ex-vessel value of the red snapper landings.

C.    An annual registered IFQ Dealer/Processor Ex-vessel Value report (IFQ Buyers report)

        from each IFQ registered buyer who operates as a shore-side processor and

        purchases IFQ red snapper would be: (i) required.

 

Motion failed by a vote of 4 to 10

 

Amendment: Payment of these fees shall be a condition of the following year’s allocation disbursement.

Motion:  to submit Reef Fish Amendment 26 to the Regional Administrator to in turn submit it to the Class 1 license holders for approval as specified in the MSFCMA.

Red Grouper Regulatory Amendment

 

Motion: Section 3.1 Preferred Alternative 5 as modified:  The red grouper recreational bag limit within the aggregate grouper bag limit is reduced to 1 per person per day.  A closed season for red grouper is established during February 15 through March 15.  Reduces red grouper landings by 33 percent.

 

Substitute Motion:  Section 3.1 Preferred Alternative 5 as modified:  The red grouper recreational bag limit within the aggregate grouper bag limit is reduced to 1 per person per day.

 

2nd substitute Motion:  to retain the original preferred alternative 5:  The red grouper recreational bag limit within the aggregate grouper bag limit is reduced to 1 per person per day and a closed season for red, gag, and black grouper is established during February 15 through March 15.  Reduces red grouper landings by 33 percent.

 

2nd substitute motion carried by roll call vote of 9 to 7

 

Motion:  For Section 3.3 - that the Preferred Alternative  be Alternative 1 – Status Quo, the grouper aggregate daily bag limit will be 5 fish.

Motion:  to submit the recreational grouper regulatory amendment to the SOC for implementation.

 

Motion carried by a roll call vote of 11 to 4 with 1 absence

 

Reef Fish – Other Business

Motion: That a new amendment be started to consider the allocation of grouper and to expedite that amendment.
