Motion: to develop two joint reef fish shrimp amendments to address red snapper rebuilding

Motion carried with no objection Law Enforcement Motion: to invite a member of the LEAP to attend the Council meetings with the Council paying the expense of that person.

Amendment 26 – Red Snapper IFQ
Motion: For Section 4.1 – IFQ Program: modify Preferred Alternative 2: “implement an individual fishing quota (IFQ) program in the GOM red snapper fishery.”

Motion: Section 4.3: For Alternatives 2 and 3 change “shall possess” to “shall own”

Motion: Section 4.5 – Action 5 add another suboption under 2a: iv. To allow the current holder of a Class 1 historical captain license to select 7 consecutive years.

Motion: For Section 4.6: To add at the end of the Preferred Alternative 2: Landings from the 1990 through 1992 period are not subject to appeal. Landings records appeals for 1993-2004 will be based on NMFS’ logbooks.

Motion: For Section 4.6: add a Preferred Alternative 5: A total of 3 percent of the current commercial quota will be initially set-aside to be used to resolve disputes regarding eligibility until the appeals process is finalized. Any amount remaining in the set-aside after the appeals process has been terminated will be proportionately distributed back to the initial recipients as soon as possible that year.

Motion: For Section 4.10 – Vessel: That Preferred Alternative be 2A: Require all fishing vessels engaged in harvesting red snapper in the IFQ program to be equipped with VMS. The purchase, installation, and maintenance of VMS equipment must conform to the protocol established by the NMFS in the Federal Register. A) The Purchase, installation, and maintenance of the VMS equipment communication costs will be paid for or arranged by the owner of the IFQ shares.

Motion: For Section 4.11, That the preferred Alternative be 2a(i) with 2b(i) and 2c(i) – the IFQ license holder will submit the fees All cost recovery fees shall be the responsibility of the recognized IFQ shareholder. The fee collection and submission will reside with the recognized IFQ shareholder. The fees would be calculated at the time of the sale of fish to the registered IFQ dealer/processor. A. The collected fees would be submitted by the IFQ shareholder to NMFS (i) quarterly. B. For all IFQ pounds landed and sold, the cost recovery fee will be based on: (i) the actual* ex-vessel value of the red snapper landings. C. An annual registered IFQ Dealer/Processor Ex-vessel Value report (IFQ Buyers report) from each IFQ registered buyer who operates as a shore-side processor and purchases IFQ red snapper would be: (i) required.

Motion: Section 3.1 Preferred Alternative 5 as modified: The red grouper recreational bag limit within the aggregate grouper bag limit is reduced to 1 per person per day. A closed season for red grouper is established during February 15 through March 15. Reduces red grouper landings by 33 percent.

2nd substitute Motion: to retain the original preferred alternative 5: The red grouper recreational bag limit within the aggregate grouper bag limit is reduced to 1 per person per day and a closed season for red, gag, and black grouper is established during February 15 through March 15. Reduces red grouper landings by 33 percent.
